Australian Skills Quality Authority (ASQA)

As the national regulator for the vocational education and training (VET) sector, the Australian Skills Quality Authority (ASQA) seeks to make sure that the sector’s quality is maintained through the effective regulation of:

  • Vocational Education and Training Providers
  • Accredited Vocational Education and Training courses, and
  • Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS) providers including those delivering English Language Intensive Courses to Overseas Students (ELICOS).

ASQA makes sure that the quality and reputation of Australia’s VET system is maintained through effective national regulation.

The Standards for Registered Training Organisations (RTOs) 2015

The Council of Australian Governments (COAG) Industry and Skills Council introduced standards for training providers and regulators to ensure nationally consistent, high-quality training and assessment across Australia’s vocational education and training (VET) system.

ASQA uses the Standards to protect the interests of all students in Australia’s VET system. The Standards guide nationally consistent, high-quality training and assessment services in the vocational education and training system.

National Vocational Education and Training Regulation Act 2011 (NVR Act)

The National VET Regulator was established as the principal national body to drive better quality VET standards and regulation and to strengthen Australia’s international VET sector. In addition the National VET Regulator provides advice to key stakeholders on issues, trends and system improvements, and provides information to providers and consumers to inform purchasing decisions and support continuous improvement in the sector.

The Australian Qualifications Framework (AQF)

The Australian Quality Training Framework (AQTF) is the national set of standards which assures nationally consistent, high-quality training and assessment services for the clients of Australia’s vocational education and training system.

The Education Services for Overseas Students Act (ESOS) 2000 and the National Code of Practice for Registered Authorities and Providers of Education and Training to Overseas Students

The Education Services for Overseas Students Act 2000 (ESOS Act) and related legislation is designed to protect the interests of students coming to Australia on student visas. The legislation aims to protect and enhance Australia’s reputation for quality education, to provide tuition protection and support the integrity of the student visa program.

The National Code of Practice for Registration Authorities and Providers of Education and Training to Overseas Students 2018

The National Code is established under the Education Services for Overseas Students (ESOS) Act 2000. To become CRICOS-registered, a provider must demonstrate that it complies with the requirements of the National Code. The National Code is a legislative instrument. It is legally enforceable and breaches of the National Code by providers can result in enforcement action under the ESOS Act.

The National Code complements existing national quality assurance frameworks in education and training including the Australian Quality Training Framework.

Smart and Skilled

Smart and Skilled is a reform of the NSW Vocational Education and Training (VET) system which provides eligible students with entitlements to government-subsidised training.

Australian Consumer Law

The Australian Consumer Law (ACL) is Australia’s national consumer protection and fair trading law. It gives consumers options for redress (refunds) and allows regulators like NSW Fair Trading to take enforcement action against businesses that break the law. It sets out the rights of consumers and the obligations of businesses, including training providers and marketers.
